Agreement
These Terms of Use (“Terms”) govern your access to and use of Circa’s mobile apps, websites, and related services (the “Services”). By creating an account, signing in, or otherwise using the Services, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Services. We may update these Terms; when we do, the effective date above will change. Continued use after updates constitutes acceptance of the revised Terms.
The Services
Circa offers personalized daily guidance and related tools based on information you provide—such as chart-related inputs, location context, journal entries, and conversations with an assistant. Features may change, be suspended, or be discontinued. We do not guarantee uninterrupted or error-free operation.
Not professional advice
Circa is for reflection and everyday planning support. It is not medical, mental-health, legal, financial, or other professional advice. Nothing in the Services diagnoses conditions, prescribes treatment, or replaces qualified professionals. If you need urgent help, contact local emergency services or a crisis line.
Artificial intelligence
Some outputs are generated by automated systems and may be inaccurate, incomplete, or inappropriate for your situation. You are responsible for how you interpret or act on suggestions. Do not rely on Circa as your sole source for decisions with serious consequences.
Accounts and eligibility
You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account. You must meet any minimum age stated in our Privacy Policy or required by the platform where you downloaded Circa.
Your content
You retain rights to content you submit. You grant Circa a worldwide, non-exclusive license to host, process, display, and distribute your content as needed to operate and improve the Services—including sending portions to AI or hosting vendors as described in our Privacy Policy.
Do not upload unlawful content, malware, others’ private information without permission, or anything that infringes intellectual-property rights.
Acceptable use
You agree not to:
- Probe, interfere with, or circumvent security or usage limits;
- Use the Services to harass, harm, or deceive others;
- Scrape, resell, or build a competing product using automated means against our consent;
- Misrepresent your identity or affiliation;
- Use the Services in violation of law or platform rules.
Third-party services
The Services may link to or integrate third-party sites or providers (for example sign-in with Google or cloud infrastructure). Their terms and privacy policies apply to those interactions.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIRCA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT PAID US.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
Indemnity
You will defend and indemnify Circa and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your misuse of the Services, or your violation of these Terms or law, to the extent permitted by applicable law.
Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if we discontinue all or part of the Services. Provisions that by their nature should survive will survive termination.
Governing law and disputes
These Terms are governed by the laws of the jurisdiction where Circa’s operator is established, excluding conflict-of-law rules. Courts in that jurisdiction have exclusive jurisdiction over disputes, unless applicable consumer law gives you a mandatory right to sue where you live.
Replace the jurisdiction sentence above with counsel-approved venue and dispute-resolution clauses (including arbitration, if desired).
General
These Terms constitute the entire agreement between you and Circa regarding the Services and supersede prior understandings on this subject. If a provision is unenforceable, the remaining provisions stay in effect. Failure to enforce a provision is not a waiver.
